SMS Communication Terms

These SMS Communication Terms (the “SMS Terms”) govern the SMS communication program operated by PurposeMed Inc. (“Freddie,” “us,” “we, “or “our”). By opting in to receive SMS messages from Freddie, you agree to these SMS Terms. These SMS Terms supplement our Terms of Service and Privacy Policy.

Program Description

If you have consented, Freddie may utilize SMS messaging to send you communications related to your care. This includes, but is not limited to, prescription refill reminders, lab kit shipment and return logistics, scheduling updates, and two-way conversations with your Freddie care team. We do not use SMS communications for promotional or marketing purposes.

Consent

Consent to receive SMS communications from Freddie is entirely optional. You may utilize our Services without opting in to SMS communications, and your consent to receive SMS messages is not a condition of obtaining or continuing any product, service, or care from Freddie. Consent is obtained through an explicit opt-in mechanism and is captured separately from any other consents you may provide to us (including consent to email communications, our Terms of Service, or our Privacy Policy).

Message frequency

Message frequency varies based on your care needs, including the timing of your prescription refills, lab tests, and scheduling. You may receive multiple messages per week during active care periods or fewer than one message per month during inactive periods.

Message and data rates

Message and data rates may apply for any messages sent to you from us and to us from you. Freddie does not charge a fee for our SMS communications. If you have any questions regarding your text or data plan, please contact your wireless provider for details.

How to opt out

You may opt out of Freddie SMS communications at any time by replying "STOP" to any SMS message you receive from us. Upon receipt of your request, you will receive an SMS confirmation acknowledging your opt-out. We will endeavour to comply with your request as soon as reasonably practicable, and in no case longer than 10 business days, as required by applicable law. This unsubscribe mechanism remains available at no cost to you. Should you choose to re-enroll, you may do so by contacting your care team or updating your communication preferences within your patient portal.

Privacy

Your phone number and SMS opt-in data are utilized solely for the purposes outlined in these SMS Terms. Freddie does not sell, rent, or share your phone number or SMS opt-in data with third parties for marketing purposes. Phone numbers are shared only with our service providers (such as our SMS messaging vendor and electronic medical record platform) who are contractually required to use the information solely to provide services to you on Freddie's behalf, and only when you have provided consent to receive SMS communications. Limitations and Interruption

SMS messages may be subject to delays or delivery failures due to factors beyond our control, including mobile carrier issues, network outages, or device settings. Carriers are not liable for delayed or undelivered messages. Freddie assumes no liability for delayed or undelivered messages. Furthermore, SMS communications must not be used for emergencies. If you are experiencing a medical emergency, please contact emergency services or your local emergency number immediately.

Changes to these Terms

We reserve the right to update or modify these SMS Terms from time to time. Material changes will be communicated to active SMS subscribers via SMS or email.
